According to court documents, Abilene police executed a search warrant Feb. 22 at Abilene Used Car Sales. Police had linked the business to an IP address being used to download and share child porn.

During the search, Benavides showed police his cellphone that contained images of child porn. "[Benavides] did later admit that he downloaded the images," the document stated.

Detectives also determined the images were later sent to Guerrero.

When police interviewed Guerrero six days later, he told police he "smashed his old phone because he knew it was evidence and that the police would be coming for it and he was worried about what [Benavides] sent him."

Guerrero was also indicted for tampering with evidence.

According to the indictment, Guerrero admitted to downloading a bunch of images on his laptop and deleting them.

When asked if he downloaded child porn while at Abilene Used Cars, Guerrero said yes.

Tommy Gregory, owner of Abilene Used Car Sales, told KTXS that Benavides and Guerrero no longer work there.

"We were shocked and very embarrassed about the whole situation," said Gregory. "We hope justice is served."
