Abilene attorney asks judge to toss evidence in theft case against Niblo murder suspect


ABILENE, Texas - The attorney for Luke Sweetser, the only publicly named suspect in the murder of Abilene real estate agent Tom Niblo, filed a motion to suppress the evidence in his theft case.

Sweetser was indicted July 20 by a Taylor County grand jury for theft of a firearm. He has not been charged in the murder of Niblo, who is his brother-in-law.

In his motion, Lynn Ingalsbe states the search warrant for Sweeter's storage facility and gun safe "fails to state probable cause" for the search and that the detective admitted he was "only speculating there 'might' be homicide evidence in the safe."

Abilene police arrested Sweetser on Dec. 14, two days after Niblo was found shot to death in his home in the 3700 block of Woodridge Drive.

The murder investigation led detectives to a storage facility in the 300 block of Mesquite Street. The gun safe and stolen guns were found in Sweetser's unit at that facility.

Neither Sweetser nor anyone authorized by him gave APD permission to search the storage unit or safe, according to the motion.

Ingaslbe said the search warrant affidavit by Detective Jeff Cowan "fails to state any logical, believable, credible or trustworthy reason" why he believed the gun safe contained evidence in the Niblo murder.

A hearing on the motion to suppress is scheduled for Oct. 26.
