Police: Texas man fractured baby girl's skull while trying to punch child's mother
AUSTIN, Texas (CBS Austin/SBG) - Austin Police say a 5-week-old girl's skull was fractured after her father punched her in the head while he was trying to strike the baby's mother.
According to an affidavit, 27-year-old Ruben A. Rodriguez came home from work on Oct. 31 and became angry at the child's mother for having gone out with a friend.
The girl's mother says she and Rodriguez began to argue before the confrontation became physical.
Police say that while the woman was holding the infant girl to her chest, Rodriguez attempted to strangle her for about 30 seconds.
The woman says Rodriguez began to punch her repeatedly in the face, and at one point he swung his fist at the mother's chin and missed, striking the baby girl on the right side of her head.
The girl's mother told police he hit the child in the head, and as the baby cried, Rodriguez allegedly told the girl's mother "Put her down so I can really (expletive) you up."
According to court documents, when the mother walked away, Rodriguez punched her in the back of the head. He fled before police could arrive.
A doctor at Dell Children's Medical Center examined the baby and found she had a large fracture on the right side of her skull, consistent with a single blow described by the child's mother.
Rodriguez is charged with injury to a child, a third-degree felony.
