Indictment: Abilene orthodontist filled prescriptions for himself using patient's names

An Abilene orthodontist accused of filling prescriptions for himself using the names of his patients, girlfriend and parents was indicted by a grand jury.

Dr. Victor Lynn Lee, 38, was indicted for possession of a controlled substance by fraud.

According to the indictment, Lee called in a prescription to a CVS on June 22, 2017 for two patients for Xanax and Klonopin.

The pharmacist called police because she found it odd “due to the patient’s age and being prescribed as needed with the amount being 90 pills and three refills.”

Lee gave three different DEA numbers which were all incorrect, according to the indictment.

The pharmacist did not fill the prescriptions because she thought someone might be impersonating Lee.

Later that day, police say Lee tried to pick up the prescriptions.

The pharmacist told him the patients would need to have their primary care physician call it in.

During the investigation, police spoke to Lee’s ex-girlfriend. She said Lee wrote her a prescription on March 3, 2017 for flu medication.

At the same time, she said he called in a prescription for Alprazolam and Clonazepam. She told police she did not take anything but the flu medicine.

The ex-girlfriend said Lee picked up the prescriptions for Alprazolam and Clonazepam and took the pills.

Logs from the CVS back up her story, according to police.

Dr. Lee declined to speak omn camera, but his office sent the following statement to KTXS in regards to the indictment:

These are the same allegations that have already been publicized. It is unfortunate that these charges are still being pursued and publicized. Dr. Lee has legal counsel and adamantly denies the accusations. He believes in the constitutional promise that all citizens are innocent unless and until proven guilty, and he looks forward to all of the facts being brought to light. In the meantime, he will continue doing his good work, both professionally and as a member of this community.

Lee also faces charges in a separate case. Police say he sent nude photos of his ex-girlfriend to her ex-husband.

According to court documents, he also sent the ex-husband photos of her and Lee having sex.
